Hadrat Sayyiduna Imran bin Husain May Allah be pleased with him narrates that once a female from the Juhainah tribe approached the Holy Prophet May Allah send peace and blessings upon him and admitted:

“O Prophet of Allah! I have become entitled for punishment, therefore please dispense this punishment upon me.” The Holy Prophet May Allah send peace and blessings upon him then called forward her guardian (meaning someone who was the elder in her tribe) and informed him, “Care for her properly and when the child is born, bring her back.”

The person did as he was told. The Holy Prophet May Allah send peace and blessings upon him then ordered that her clothes be tied properly against her body and that she should be stoned (to death). Thereafter, she was stoned to death. The Holy Prophet May Allah send peace and blessings upon him, also performed her Janaza Salaah!

Hadrat ‘Umar May Allah be pleased with him then inquired, “(O Prophet of Allah! May Allah send peace and blessings upon him) She had committed adultery and yet you had performed her Janazah Salaah?” The Holy Prophet May Allah send peace and blessings upon him replied, “She had made such Taubah that if it were to be distributed among seventy people in Madina Shareef, it would be sufficient for them to be pardoned. Is it not enough that for the sake of Allah Almighty she had given her life.” (Muslim Shareef).

A person who makes sincere Taubah should not be further insulted!

Hadrat Imam Nawawi May Allah shower mercy upon him explains that, “There were two reasons for the Holy Prophet May Allah send peace and blessings upon him strictly instructing the guardian of this female to take care of her properly.
1. So that feeling insulted as a family and tribe, they do not end up abusing and insulting her.
2. Because she had performed proper and sincere Taubah and by virtue of the fact that she had presented herself willingly for punishment, therefore, she was not to be mistreated.” (Sharah Muslim)

Why has worldly punishment also being prescribed for people?

The religion of Islam is a complete way of life. When one sincerely practises upon it, he or she becomes successful in both worlds. Where Islam has informed people of immense reward in both worlds for doing good, in like manner, Islam has informed people of punishment in both worlds when doing bad and evil. This is the best form of warning people and prohibiting them from further doing bad and evil and at the same time, encouraging people in doing good and noble deeds.

The nature of people are different. Some people refrain from doing evil for the sake of Allah Almighty. Some people refrain from doing bad out of fear for the Divine Wrath of Allah Almighty and some people do this out of fear for the punishment of the Hereafter. Then, there are people who have become oblivious of these warnings because they feel that the Hereafter is very far away. However, since the punishment of this world is immediate, people become fearful and cautious and this creates a stable and safer environment in the world. Therefore, these punishments prescribed by Islam in this world can never be considered as oppression but rather a means of actually eradicating oppression and tyranny. When one person is punished, it would become a lesson for others who are watching this.

Adultery is a crime which destroys the family lineage of a person. Islamic law has given specific and strict rules about maintaining these factors. Therefore, a person who ignores this important rule, would have to face the punishment of their action. Explaining the impermissibility of adultery, the Qur’an declares:

In Surah Bani Israel, verse 32, Allah Almighty declares:

“And do not approach adultery, undoubtedly, that is immodesty and a very vile path.”

In Surah Furqan, verses 68, 69, Allah Almighty declares:

“And those who cry not to any other god along with Allah, nor take the life which Allah has forbidden save in (the course of) justice, nor commit adultery and whosoever does this, shall pay the penalty; The doom will be doubled for him on the Day of Resurrection, and he will abide therein disdained for ever;”

In Surah Nur, verse 2, describing their punishment, Allah Almighty declares that:

“The woman and the man guilty of adultery flog each of them with a hundred stripes: let not compassion move you in their case in a matter prescribed by Allah if you believe in Allah and the Last Day: and let a party of the Believers witness their punishment.”

Explaining this verse, Allama Moulana Na’eemudeen Muradabadi May Allah shower mercy upon him declares, “This command is for the people in power clearly explaining that punishment for a male and female who are guilty of adultery is one hundred lashes. This is for the person who is free and unmarried. For the person who is married, the penalty is death by stoning. During his punishment by whipping, the male would be made to stand upright. His entire clothes should be removed except for the clothes below his navel and his entire body would be whipped except his face, his head and his private part. The whipping should be of medium strength.

“The female would not be made to stand up and neither should her clothes be removed. Testimony or proof for adultery is established by the testimony of four males or a person admits to this four times. However, the judge should continue to ask so there remains no doubt whatsoever. In other words, every possible question should be asked and asked from all angles so that absolute evidence is established.

“Homosexuality is not considered as adultery, however, the punishment for this is also applicable. There are different statements in this regard from the blessed companions. One is to throw both of them into a fire, the second is to drown them, the third is to throw them from a high and elevated area and the fourth is to throw stones at them.”

A most amazing punishment which he gave himself!

One day, Nabi ‘Isa Alaihis Salaam went out of the town to make Du’a for rain. At that moment, Allah Almighty revealed to him, “O ‘Isa! Do not make supplication for rain because among you are also people who have committed (grave) sin”.

Nabi ‘Isa Alaihis Salaam then informed those around him of this and also informed everyone around him that whosoever is a sinner should return to their homes.

When they they heard this, only one person remained. This person was someone who had one eye. He asked this person why he had not gone back and the person replied, “O Prophet of Allah! I have never disobeyed Allah Almighty for one moment. However, one day, without intent, my eyes fell on the feet of a female. I then removed that eye of mine. If the other eye had also done this, I would have also removed that eye as well.”

When Nabi ‘Isa Alaihis Salaam heard this, he began to weep until his beard became wet. He then requested the person to make Dua for rain because he had protected himself his entire life from committing sin. Before the person had finished making Du’a, it began to rain. (Oyunul Hikaayah)

Points to remember

1. As much as a person is pious, so much so should this person be regretful about his sins and transgression.
2. The religion of Islam has established punishment for certain crimes and if these laws of Islam are adhered to, crime in the world would certainly decrease.
3. A pregnant married female who has committed adultery should be allowed to give birth first before the punishment is given. (Ad Durrul Mukhtaar)
4. The proper Islamic Ghusal and burial of this person who has been executed should be carried out. (Tanweerul Absaar)

The amazing food container of Hadrat Sayyiduna Abu Hurayrah May Allah be pleased with him!

Hadrat Sayyiduna Abu Hurayrah May Allah be pleased with him narrates that, “Once, there was no food available for the Muslims in a certain battle. The Holy Prophet May Allah send peace and blessings upon him then asked me whether I had anything and I replied that there were a few dates in my food box. He then requested me to bring them to him. I then brought the dates to him and it was about twenty one dates.

“The Holy Prophet May Allah send peace and blessings upon him then covered them with his blessed hands and asked me to call ten people at a time. They arrived, consumed as much as they could and then left. The entire army was fed from these few dates! The Holy Prophet May Allah send peace and blessings upon him then asked me to keep the balance in the food container and that I should take out dates from this food container whenever I wanted.

“This continued until the Holy Prophet May Allah send peace and blessings upon him was in this world. I then continued to eat from this same food container and also to give others until the Khilaafah of Hadrat Sayyiduna ‘Uthman Ghani May Allah be pleased with him. In this period, someone finally stole this food container.” (Al Khasaa isul Kubra)
